Privacy Policy

Mediagility Limited is committed to protecting and respecting the privacy of the users of our website or services and our clients.

This policy sets out the basis on which any personal data we collect, or that is disclosed to us, will be used or processed.

Mediagility Limited provides a website and services (Mediagility) that are used to setup and operate online collaborative environments. Mediagility is normally used to create formal and informal affiliations of organisations and people working together on, or participating in, a project or event.

By visiting Mediagility, registering as a user or activating a user account that has been created for you by a person, group or organisation through Mediagility, or using Mediagility, you consent to the collection, use and transfer of your information as provided for by this policy.

For the purpose of the Data Protection Act 1998, the data controller is Mediagility Limited

In some cases Mediagility may be presented in skins that intentionally make it look and feel like our client organisation's website or corporate identity. In these cases you will always see a reference to Mediagility® and our logo displayed somewhere on the screen.

Mediagility may contain links to and from the services and products of our partner networks, advertisers and affiliates. Please note that these organisations will have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these organisations.

Information we may collect

During Registration and/or Affiliation

Information that you provide when you register with Mediagility, setup or affiliate with an existing workspace, project or event, or you or your organisation subscribes to Mediagility. Examples of the information collected include your name, contact details, addresses and, if necessary, organisation name, company registration information and tax reference numbers, and credit or debit card information.

The password you choose when registering with Mediagility or when you access a user account created for you by another user through Mediagility, is a vital part of keeping your personal information private. You are responsible for keeping this password secure and confidential. We ask you not to share your password with anyone. You are advised to change it regularly and contact us immediately if you suspect for any reason that it has been disclosed or used to gain unauthorised access to Mediagility.

Whilst accessing or using Mediagility

When you are visiting or accessing Mediagility we may record, among other information, the resources that you access, the pages visited with the date and time, traffic data, location data and other communication data, your IP address, computer operating system and browser type.

This is statistical and technical data about your browsing actions, patterns of use and your technology platform. It is used for systems administration and operation and to improve your user experience. It does not identify you individually.

While you are visiting or accessing Mediagility we may need to write temporary cookies ("session cookies") to the web browser you are using.

These session cookies are only used to manage your interaction with Mediagility. We do not need them to remain after you have browsed away from Mediagility and your browser should delete them automatically.

If you prevent or otherwise block session cookies from being written to your web browser you may be unable to access Mediagility. Refer to your web browser help to learn how to change your cookie preferences. Set your web browser to allow temporary or session cookies when you want to access Mediagility.

When communicating with us

If you report a problem with Mediagility, make a suggestion or you participate in any research we may be conducting, we may keep a record of your correspondence or the responses you give.

If you request additional information about Mediagility, recommend Mediagility to other people, or participate in a Mediagility forum or blog, you will be asked for information that will include your name and email address.

Where we store your information

The information that we collect from you may be transferred to, and stored at, a location outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or a third party. Such staff may be engaged in, among other things, the processing of your payment details and the provision of support services. By visiting, registering with or accessing Mediagility, you agree to this transfer, storing or processing.

We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this privacy policy and European or UK law.

The transmission of information via the internet cannot be guaranteed as completely secure. Although we will do our best to protect your information, we cannot guarantee the security of any information transmitted to and from Mediagility; any transmission is at your risk. Any information stored by us is protected by strict procedures and security features with the intention of preventing unauthorised access or use.

Changes to our Privacy Policy

We may from time to time change our privacy policy, the current version of which will always be available from Mediagility. Visiting or accessing Mediagility always constitutes your agreement to our current privacy policy.

If you are a registered user of Mediagility you will be notified of any change to our privacy policy. Your continued use of Mediagility will be dependant upon you agreeing to the amended privacy policy.

How we may use the information we collect

We use information held about you and your use of Mediagility in the following ways:

  • To enable you to access Mediagility and operate your user account;
  • To supply, charge for, support and administer any products or services we are contractually required to provide to you or that you have requested;
  • To administer, support, improve and develop the products and services provided;
  • To compile statistical analysis of how Mediagility is accessed and used by you;
  • To monitor the frequency of your use of Mediagility;
  • To provide you, or someone you nominate, with information, products or services that you request from us.

Why we may contact you

In providing us with your contact details, you agree that we (or any organisation you are affiliated to through the use of Mediagility) may keep you informed about:

  • The operation of your user account – including account activation, username changes, password and account email changes and expiry, denial of access, security, and (if applicable) account billing;
  • Changes in relation to your user account and/or subscription services;
  • Changes made to the products and services you are using;
  • The availability of new products and services from us or any organisation you are affiliated with through Mediagility;
  • The availability of Mediagility – including notification of scheduled maintenance and outages, unscheduled outages, compensation (if applicable) and quality of service issues.

Authorised Information Disclosure

We may disclose your information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.

We may also (if required) disclose your information to the following third parties:

  • Our third party service providers as necessary for the fulfilment of contractual obligations to you and the proper functioning of the services we provide;
  • Any person to whom we propose to transfer any of our rights and obligations under any agreement we have with you;
  • Regulators, our professional advisers and external auditors;
  • Any agent acting on behalf of us;
  • Any organisation you are affiliated with through Mediagility;
  • In the event that we sell or buy any business or assets, in which case we may disclose your information to the prospective seller or buyer of such business or assets;
  • If we or substantially all of our assets are acquired by a third party, in which case information held by us about our customers will be one of the transferred assets;
  • If we are under a duty to disclose or share your information in order to comply with any legal obligation, or in order to enforce or apply the Terms of Use, or Subscription or other agreement you are a party to; or to protect the rights, property or safety of us, our employees, contractors, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Access to your Information

If you are a registered user of Mediagility and want to review or correct any information we hold about you, log in to your user account and use the tools available to view and correct your information.

If you are not a registered user of Mediagility then the personal information we hold (if any) will be very limited and can only be compiled for you if you make your request in writing.

Your request must include the email address you have used when interacting with Mediagility (as this is the only way we will be able to retrieve any information we may have) and will only be actioned if you are able to identify yourself without doubt and prove your ownership of, or right to use, the email address you have provided.

Actioning any request received in writing may be subject to a fee (payable in advance) to meet our costs in responding to your request, regardless of whether or not we hold any information about you.
